Man dies after night club brawl
The partner of a man who died after being stabbed in a fight outside of a nightclub appeals for the Criminal Injury Compensation Association (CICA) to reassess it's decision.
The victim died from a stab wound to the neck. The defendant alleged he had acted in self defence and that the victim had in fact produced the knife.
The defendant was charged with murder but later died in police custody before the trial had gone to court.
The victim's partner applied to the CICA for compensation but it was initially rejected by the association on the grounds that the victim's own behaviour had been inappropriate.
Saying that "his conduct of engaging in verbal and physical altercation with the defendant had led to his death" and thus barred her from claiming compensation.
However, statements taken by police are evidence to the fact that the victim was neither excessively drunk nor overtly aggressive. The statements all suggest that the defendant was actively seeking a fight, even those given by the defendant's friends.
