Permanent injury to bikers foot and knee when car doesn’t see motorcyclist
The driver of a car who pulled into the path of a motorcycle tried to blame the motorcyclist for the accident. Jamie was riding his motorcycle to work, a route he took twice a day. He was an experienced motorcyclist but even he couldn't take any evasive action when a car pulled out of a side road right in front of him. The driver of the car hadn't noticed Jamie on his motorbike.
Jamie suffered severe leg injuries damaging his knee and his foot. He has undergone many operations since the accident but his injuries are so significant that he will be permanently restricted in his movement and what he can do.
The defendant argued that Jamie had been driving too fast and was therefore partially to blame for his accident. They tried to say that it was 50/50. However it was clear from the evidence that Bond Pearce had gathered that Jamie was travelling at 30mph. Bond Pearce advised Jamie not to accept any blame for his accident even when the defendants increased their offer to 75/25 in Jamie's favour. We went to court and the judge agreed with us that the defendant was 100% to blame for the accident which meant that Jamie received 100% of the compensation award. This was vital in ensuring Jamie will have some financial security and be able to afford to get the treatment and rehabilitation he needs.
